Terms of Service

Please read this carefully before using MentalSynch. It covers what you can expect from us, what we expect from you, and the legal ground rules for both.

Important

This is a legally binding agreement between you and Elom Labs (operator of MentalSynch). If you don't agree to these Terms, please don't use the platform. For a medical or safety emergency, call 999 or 112 immediately — do not wait on a response from MentalSynch.

Acceptance and Eligibility

  • By creating an account or using MentalSynch, you agree to be bound by these Terms of Service and our Privacy Policy
  • You must be at least 18 years old to use MentalSynch
  • You must provide accurate information when registering, and keep it up to date
  • You are responsible for keeping your account credentials confidential and for all activity under your account
  • One account per person — accounts may not be shared or transferred
  • You must notify us promptly if you suspect unauthorized access to your account

Permitted Use

  • Use MentalSynch to seek or provide mental health support, in line with your role on the platform
  • Book, attend, and pay for sessions with verified professionals
  • Use the personality assessment, mood tracking, journaling, and other self-guided wellness tools
  • Participate in community and peer support spaces, respecting the anonymity and safety of others
  • Earn and claim XP, achievements, and (where enabled) on-chain badges through genuine use of the platform

Prohibited Activities

  • Sharing, selling, or transferring your account credentials to anyone else
  • Using the platform for any unlawful purpose, or in a way that violates the rights of others
  • Attempting to bypass, disable, or interfere with the platform's security, or to access data that isn't yours
  • Uploading malware or attempting to disrupt the service for other users
  • Impersonating another person, a professional, or MentalSynch staff
  • Sharing another user's personal information, or content from anonymous peer spaces, outside the platform without consent
  • Providing professional mental health treatment through the platform without being verified to do so
  • Attempting to manipulate the XP, achievement, or on-chain badge system through automated or fraudulent means
  • Harassment, hate speech, or discriminatory behavior toward any other user or professional

Payments & Escrow

  • Session and subscription fees are shown to you before you confirm payment
  • Payments are processed by Paystack; MentalSynch does not store your full card details
  • For one-on-one sessions, payment is held in escrow and released to your therapist using a release code once the session is confirmed complete
  • Subscription fees, where applicable, are billed on a recurring basis and may change with at least 30 days' notice to subscribers
  • Refunds are handled case by case — contact us if a session didn't take place as booked or you were charged in error
  • Failed payments may result in suspension of paid features until resolved
  • Cancelling a subscription takes effect at the end of the current billing period, unless otherwise stated at checkout

Medical Disclaimer

  • MentalSynch is a platform that connects you with independent, licensed professionals and provides self-guided wellness tools — it is not a hospital, clinic, or emergency service
  • Professionals on MentalSynch practice independently and are responsible for the clinical advice and care they provide; MentalSynch does not itself provide medical or clinical treatment
  • AI-assisted features (matching, crisis triage, insights) are decision-support tools, not medical diagnoses, and do not replace clinical judgment
  • In a medical or safety emergency, contact Kenya's emergency services (999 or 112), the Kenya Red Cross (1199), or your nearest hospital immediately — do not rely on MentalSynch for emergency response
  • We do not and cannot guarantee any specific treatment outcome; results depend on many factors outside our control, including the professional you work with and your own engagement with treatment

On-Chain Achievement Badges

  • Achievement badges are optional, non-transferable ("soulbound") digital tokens that record milestones in your wellness journey on the Avalanche blockchain
  • Badges have no cash or monetary value, cannot be sold or traded, and are not an investment or financial product
  • This feature currently runs on Avalanche's public test network (Fuji), not mainnet — it is provided as-is and may change, be reset, or be discontinued as the feature develops
  • Because badge mint transactions are recorded on a public blockchain, they cannot be deleted or reversed, even if you close your MentalSynch account
  • We are not responsible for losses connected to blockchain network conditions, wallet infrastructure, or third-party blockchain services outside our control

Intellectual Property

  • MentalSynch and Elom Labs own the platform, its design, and its underlying technology
  • You retain ownership of the personal content you create — journal entries, posts, and similar material
  • We grant you a limited, personal, non-transferable license to use the platform for its intended purpose
  • You may not copy, modify, or redistribute our proprietary content or technology without permission
  • Content posted in community spaces may be moderated or removed at our discretion to keep those spaces safe

Limitation of Liability

  • The platform is provided "as is" and "as available," without warranties of any kind, express or implied, including as to uninterrupted or error-free operation
  • To the maximum extent permitted by Kenyan law, MentalSynch and Elom Labs are not liable for indirect, incidental, or consequential damages arising from your use of the platform
  • Nothing in these Terms limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by our negligence, fraud, or any liability that Kenyan law does not allow us to exclude
  • Where our liability can lawfully be limited, our total liability to you for any claim arising from these Terms is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim
  • We are not responsible for the independent professional judgment, advice, or conduct of therapists, psychiatrists, or physiotherapists using the platform — your relationship with them is separately governed by professional standards and, where applicable, their own terms of care
  • We are not liable for outages or failures of third-party services we rely on (payment processing, video infrastructure, blockchain networks) that are outside our reasonable control

Governing Law & Disputes

  • These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles
  • Before either of us starts a formal legal claim, we agree to first try to resolve the dispute informally by contacting each other directly
  • If it can't be resolved informally, disputes will be subject to the exclusive jurisdiction of the courts of Kenya
  • If any provision of these Terms is found unenforceable, the rest of the Terms remain in full effect
  • These Terms, together with our Privacy Policy, are the entire agreement between you and MentalSynch regarding the platform

By continuing to use MentalSynch after changes to these Terms take effect, you agree to the revised Terms. This document is not a substitute for independent legal advice.
